Your marital status matters because when you accept a secured loan offer, the fixtures in your home become collateral to secure your loan. If your address is in a community property state, your spouse (or another person who has community property rights under state law) may have an interest in the property, including in the fixtures.
We’ll require assurance that each of you, and any other owner of the property, are aware of the secured loan and will not interfere with our ability to collect on or enforce your loan.
Currently, the nine community property states are:
- Arizona
- California
- Idaho
- Louisiana
- Nevada
- New Mexico
- Texas
- Washington
- Wisconsin
Alaska also allows couples to opt in to community property rules.
